1. Agreement to Terms
These Terms of Service ("Terms") govern your use of apptechies.com (the "Site") and your interactions with Apptechies ("Apptechies," "we," "us," or "our") through the Site, including contact forms, consultation requests, and job applications. By using the Site, you agree to these Terms. These Terms do not cover the delivery of a software development project itself. That scope, pricing, timeline, and deliverables are governed by the separate Master Services Agreement or Statement of Work signed for that engagement, which takes precedence over this page for anything it addresses.
2. Use of the Site
You agree to use the Site only for lawful purposes. You agree not to:
- Submit false or misleading information through any form on the Site.
- Attempt to gain unauthorized access to any part of the Site, its admin systems, or underlying infrastructure.
- Reverse-engineer, decompile, or disassemble any part of the Site's code or functionality.
- Use automated means to scrape, crawl, or extract content beyond normal search-engine indexing.
- Interfere with the Site's normal operation, including its forms, chat widget, or hosting infrastructure.
- Use the Site to transmit spam, malware, or unlawful content.
3. Restricted Areas & Accounts
Parts of the Site, such as the admin panel used by Apptechies staff, are password-protected and restricted to authorized personnel only. If you are issued credentials for a restricted area (for example, as an Apptechies employee or an authorized client reviewer), you are responsible for keeping those credentials confidential and for all activity under your account. We may suspend or revoke access to a restricted area at any time if we reasonably believe it is being misused.
4. Confidentiality
When you share project details, business plans, or other non-public information with us, whether through a contact form, a discovery call, or a signed engagement, we treat it as confidential and use it only to respond to your inquiry or deliver the engagement it relates to. For any engagement involving sensitive or proprietary information, we are comfortable signing a mutual NDA before a detailed discussion, consistent with the approach described on our Compliance page. Just raise it when you reach out.
5. Intellectual Property
The Site's design, layout, original text, graphics, and the Apptechies name and logo are owned by Apptechies or its licensors and are protected by copyright and trademark law. You may not reproduce, copy, or redistribute Site content for commercial purposes without our written permission.
Portfolio project names, client logos, and case-study details shown on the Site remain the property of their respective owners and are shown with permission to illustrate work we have delivered. See Section 10 of our Privacy Policy for how we handle third-party marks.
Ownership of code, designs, and other deliverables produced during an actual client engagement is addressed separately in that engagement's contract. Full IP assignment to the client is our standard practice once an engagement is delivered and paid in full, unless a signed contract states otherwise.
6. Proposals, Quotes & Estimates
Any cost ranges, timelines, or scope descriptions shown on the Site or shared in an initial conversation are indicative estimates based on the limited information available at that stage, not a binding quote. A binding price, timeline, and scope are only established in a signed Statement of Work following a proper discovery and scoping process. Nothing on this Site constitutes a contractual offer capable of acceptance.
7. Site Availability & Changes
We aim to keep the Site available and accurate, but we may modify, suspend, or discontinue any part of it, including specific pages, forms, or content, at any time without prior notice. We are not liable for any inconvenience caused by planned or unplanned downtime.
8. Third-Party Links
The Site may link to third-party websites, such as a client's live product, a social media profile, or a technology partner's site. We do not control and are not responsible for the content, privacy practices, or availability of those third-party sites. Linking to a site does not imply our endorsement of everything on it.
9. Disclaimers
The Site and its content are provided "as is" without warranties of any kind, express or implied. We make reasonable efforts to keep information on the Site accurate and current, but we do not warrant that the Site will be uninterrupted, error-free, or completely secure. Case study results, metrics, and timelines described on the Site reflect outcomes for specific past clients under their specific circumstances and are not a guarantee of results for any future engagement.
10. Limitation of Liability
To the fullest extent permitted by law, Apptechies will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site. This limitation does not apply to liabilities that cannot lawfully be excluded, and it does not affect or limit the terms of a signed client contract, which governs liability for actual project delivery separately.
11. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which the relevant Apptechies contracting entity is incorporated, without regard to conflict-of-law principles, unless a signed client contract specifies a different governing law for that engagement. We will always try to resolve a disagreement directly and in good faith before either party pursues formal proceedings. Where a dispute involves a specific regional office, the courts local to that office's jurisdiction have non-exclusive jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when it was last revised. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. Material changes affecting an active client contract are handled through that contract's own amendment process, not through this page.
